  1. Service Definition:

  1. Prices and Payments:

Prices: The prices of MilaHosting's hosting services are mostly established in US dollars, Argentinian pesos, and Chilean pesos and are subject to change without prior notice.

Billing: MilaHosting's hosting services are billed on a monthly or annual basis, depending on the customer's choice. The invoice will be issued on the date the service was contracted and will be delivered to the email provided by the customer.

Payment: Payment must be made in full before the hosting service is activated. Payment can be made by credit card, bank transfer, or PayPal.

Taxes: MilaHosting's hosting service prices do not include taxes. The customer is responsible for paying any applicable taxes according to local laws and regulations.

Discounts: MilaHosting reserves the right to offer discounts to customers at its discretion. Discounts do not apply retroactively.

  1. Renewal and Cancellation:

Renewal: If the customer wishes to renew the hosting service, it must be done before the expiration date to avoid suspension or extra charge for non-payment of the service. MilaHosting will automatically renew the hosting service unless otherwise requested.

Cancellation: The client can cancel the hosting service at any time by providing a valid reason to approve such request in case of any user error. However, no refunds will be provided for the remaining months of the service if it is canceled before the expiration date.

Suspension: If the customer does not pay the invoice before the expiration date, the hosting service will be temporarily suspended until payment is made, and in some cases, a non-payment charge may be added.

The user is solely responsible for all content and materials provided on their website, game, VPS, or dedicated server. The user agrees to comply with all applicable laws and regulations related to the use of the hosting service provided by MilaHosting.

The user acknowledges and agrees that all content and materials provided on their website, game, VPS, or dedicated server are the property of the user or the corresponding copyright holder.

Copyright Complaints: MilaHosting is committed to complying with all applicable laws and regulations related to copyright and intellectual property. If a copyright violation complaint is received, MilaHosting will notify the affected user and may take reasonable steps to resolve the issue if it affects MilaHosting.

MilaHosting shall not be responsible for any damages resulting from the user's conduct, and reserves the right to take measures to protect its interests and those of its clients.

Indemnification: The user agrees to indemnify, defend, and hold MilaHosting, its directors, employees, and representatives harmless from any claim, demand, damage, cost, or expense, including reasonable attorney's fees, resulting from any breach by the user of these terms and conditions.

Problem resolution: MilaHosting is committed to doing everything possible to resolve technical support issues in a reasonable timeframe. However, MilaHosting does not guarantee the resolution of all technical support issues, especially those that are outside of MilaHosting's control.

  • Using the service to send unsolicited emails (spam) or to carry out denial of service attacks (DDoS) or other cyber attacks.

  • Failure to comply with payment terms and the user's financial obligations regarding the service.
  • Defaming MilaHosting or attempting to damage its reputation.
  • Damaging the service of other MilaHosting customers.
  • Carrying out attacks or damage to MilaHosting services.

In the event of a suspension or cancellation of the service, the user will not be entitled to any refund or compensation for the remaining time in their billing period.

If the user wishes to restore the service after a suspension or cancellation, they must contact MilaHosting and take steps to remedy the infringement, subject to MilaHosting's approval.

The user's breach of any clause of this agreement may result in the cancellation of the service without prior notice and without liability on the part of MilaHosting.

In the event that MilaHosting cancels the service due to the user's breach, no refund of the charges already paid will be made.

The user will be responsible for paying all outstanding charges up to the date of cancellation, including any applicable cancellation fee.

MilaHosting reserves the right to suspend or cancel the service at any time and for any reason if it determines that the user is using the service improperly or illegally, or if their activity is causing harm to other users, the server, or the network.

The client is responsible for maintaining complete and up-to-date backups of their data, files, and software programs.

MilaHosting shall not be liable for any failure to perform our obligations under this agreement if such failure is caused by events beyond our reasonable control, including, but not limited to, acts of war, terrorism, civil unrest, natural disasters, disruptions in power supply, communication networks failures, and other similar events.

Under no circumstances shall the total liability of MilaHosting for any claim related to our services exceed the total amount that the client has paid for such services in the 12 months preceding the event that gave rise to the liability.

The client agrees to indemnify and hold harmless MilaHosting and its affiliates, employees, directors, and agents from any claim, damages, liability, cost, and expense, including reasonable attorney's fees, arising out of the use of our services or the breach of these terms and conditions by the client.

These terms and conditions regarding Limitation of Liability govern the use of MilaHosting's hosting services for games, VPS, dedicated servers, and websites. By using these services, the client agrees to and acknowledges these terms and conditions in their entirety.

  1. Refund Policy:

The following Refund Policy sets out the conditions and terms governing the refund process for products and services offered by MilaHosting.

Satisfaction Guarantee At MilaHosting, we are committed to our customers' satisfaction, so we offer a satisfaction guarantee for all our products and services. If for any reason our products or services do not meet your expectations, you may request a refund within the time frame set forth below.

Refund Period The refund period varies depending on the purchased product or service. For our hosting products and services for games, VPS, dedicated servers, and websites, the refund period is 3 days from the date of purchase. For our domain products and services, the refund period is 5 days from the date of purchase.

Refund Procedure To request a refund, the customer must send an email to our support team indicating the reason for the request and the transaction details. The support team will review the request and determine if the conditions for the refund are met.

If the refund is approved, MilaHosting will process the refund to your MilaHosting web account only in extreme cases approved by MilaHosting, the refund will be made to the same payment method used for the original purchase. The processing time for the refund may vary depending on the payment method used.

      The refund policy does not apply to the following situations:

  1. Client's misconfiguration.
  2. Use of third-party plugins.
  3. Service functioning correctly.
  4. Issues external to the hosting, such as DDoS attacks or datacenter connection problems.
  5. Service maintenance.
  6. Third-party access to your personal account due to sharing information by the client.

Exclusions from the Refund Policy The refund policy does not apply to the following products and services:

Server setup and customization services. Accounts suspended or canceled for violation of our terms and conditions. Products and services purchased through authorized resellers of MilaHosting.

Changes to the Refund Policy MilaHosting reserves the right to modify this Refund Policy at any time and without prior notice. The changes will take effect from their publication on our website. It is the customer's responsibility to periodically review the Refund Policy to be informed about any changes made.

  1. Backup Policy:

MilaHosting offers hosting services for games, VPS, dedicated servers, and websites that include regular backups to protect user data. The use of these backups is subject to the following terms and conditions:

MilaHosting will perform backups of user data at regular intervals, however, the integrity, accuracy, or availability of such backups is not guaranteed.

The user is solely responsible for ensuring that their data is properly backed up and that additional backups are performed as needed.

MilaHosting shall not be responsible for any loss or damage of user data, including data stored in backups.

MilaHosting reserves the right to retain old backups for a limited time before deleting them to ensure system integrity and data availability.

Users may request the restoration of their data from a backup through the MilaHosting control panel, however, fees may apply for this service.

MilaHosting does not guarantee the availability of specific backups and reserves the right to refuse to provide a backup if it is deemed harmful to the system or other users.

The user acknowledges and agrees that MilaHosting may delete backups at any time without prior notice, however, MilaHosting will endeavor to notify the user of such action where possible.

By using MilaHosting's hosting services, the user agrees to these terms and conditions and acknowledges that they are solely responsible for ensuring the integrity of their data and performing additional backups as needed.
